The Michigan Real Estate Board approved a new set of regulations on Wednesday November 17, 2018. The regulations will apply to the growing and selling of cannabis in Michigan come January 2020. Under the new regulation businesses will be required to secure a license from the Department of Licensing and Regulatory Affairs, under the oversight of the Cannabis Regulatory Agency.
The main highlights of the new rules are as follows: The regulations are updated and will be available on the Michigan cannabis website.
Michigan voters approved legalization of recreational marijuana in a November 2018 election. According to the Detroit Free Press, “The new rules take effect immediately but don’t apply to people who want to grow or sell medical marijuana until licensing begins in March 2019.” In 1971, President Richard Nixon declared a war on drugs that included cannabis.
The Controlled Substances Act of 1970 classified marijuana as a Schedule I drug because the plant and its extracts were deemed to have no accepted medical use in the United States, a definition which has been hotly contested. In 1996, California became the first state to legalize medical marijuana. President Barack Obama’s administration took a hands-off approach to states legalizing cannabis for medicinal or recreational purposes but in 2013 U.S.
Deputy Attorney General James Cole issued guidelines to federal prosecutors stating that they should not interfere with state legalization efforts so long as eight federal priorities were addressed: The Trump administration took office in 2017 and Jeff Sessions was appointed U.S. Attorney General by President Donald Trump.
In February 2018, Sessions rescinded the 2013 Cole Memorandum and issued a new one which also addressed cannabis sales to minors and diversion of cannabis to states where it is illegal but did not address state’s rights to legalize or decriminalize cannabis.
