Wage and Hour Class Lawsuits

The Fair Labor Standards Act guarantees fair treatment for the working class. The Act incorporates proper minimum wage, overtime work compensations, and no work off the clock. Basically it ensures workers aren’t exploited by the employer or colleagues.

If an employee feels his rights are being violated, he’s not being paid and is being exploited, he can pursue a lawsuit. The wage & hour lawyers can help identify if the case is legitimate and appropriate to move forward. They help navigate through the lawsuit so that you don’t have to be burdened by it. The claim alleging that the employer broke a law can represent thousands of workers and lead to large settlements.

Common Claims

The most common cases involve alleging that the employer violated the FLSA. This involves providing minimum wage and forcing employees to work off the clock. Working more than 40 hours a week counts as overtime. Generally employers over utilize their employees and do not keep promises. When this goes out of hand and becomes a regular thing, employees can turn to exercising their rights and pursuing a lawsuit. Sometimes when employees retaliate for their rights, they are fired from the corporation. This is where a lawsuit can bring back lost dignity and position. State laws have additional unique protective rights adhering to the particular state, which safeguard their citizens.

Class Action Lawsuit

Sometimes colleagues unitedly decide to fight for their rights. If violation is observed by a team, the group of individuals who have undergone the same harm can pursue a lawsuit together. This is termed as a class action Lawsuit. This lawsuit produces an extravagant verdict and can cause great harm to the employer and company.

Relief

Since wage and hour class lawsuits are based on the foundation of low or refraining payments, the case ends with deserved compensation being paid to the employee or group of employees. Sometimes it requires double pay back and changes in company policy. This is called Injunctive relief.

Sometimes employers falsely label employees as independent contractors or exempt from overtime.

You cannot be denied leaves, you cannot be forced into overtime work, and you cannot be denied your deserved pay. You can always stand up for what is right and demand compensation. Unpaid wages lawsuits are only liable for 2 years. Hence, one needs to file it as soon as they can and get out of the exasperating situation.
